THE PARTIES AGREE TO THE FOLLOWING:

1. PREAMBLE

The preamble forms an integral part of this agreement as if it were fully reproduced herein.

PRINCIPAL CLAUSES

2. The Member agrees to sign up for the Trainer's remote coaching membership.

3. The Trainer will provide remote coaching services through Zoom, Teams, or other platforms.

4. The Member agrees to pay a joining fee of X$.

5. The Member agrees to make payments Bi-Weekly/Monthly/Quarterly/Semi-Annually/Annually in the amount of X$, including taxes, beginning on [DATE] and continuing until either party terminates the contract.

6. The Member authorizes X Gym (or its franchises) or its appointed agent to debit the Member’s account as indicated in the attached voided check or deposit slip for the specified term. The discontinuation of this payment method does not release the Member from the obligation to fulfill the terms of this contract.

7. By accepting this contract, the Member is granted access to the facilities offered by the Gym (hereafter "the Provider"), subject to compliance with the Provider’s rules, regulations, and policies when accessing the facility.

8. The Trainer agrees to fulfill the following responsibilities:

a) Provide the Member with an exercise program suited to their needs.

b) Discuss relevant topics such as diet and weight respectfully and professionally.

c) Perform standardized tests and take measurements such as body fat analysis, known as Opex Body.

9. Besides their payment obligations, the Member is responsible for taking their own measurements and providing exercise videos, as the coaching will be done remotely.

10. The Trainer acknowledges that they are not a licensed medical professional and can only offer publicly available advice.

CANCELLATION & TERMINATION POLICY

11. The Member must provide a 24-hour notice for any cancellations. Failure to do so will result in the session being forfeited.

12. Either party may terminate this contract by providing written notice to the other party 30 days in advance. Any cancellation fees equal to 50% of the remaining fee will apply.

13. The Provider reserves the right to suspend or terminate this contract for violations of terms, rules, policies, or non-payment of fees without further notice.

LIABILITY CLAUSE

14. The Member acknowledges that participation in the program involves risks and voluntarily releases the Provider from any claims or causes of action arising from personal injury, property damage, or wrongful death resulting from the Member’s negligence or non-compliance during the program.

15. Parents or Legal Guardians of Minors: The undersigned parents or legal guardians agree that the terms of the liability clause apply to their minor child’s participation in the program. They release the Provider from liability for any injury or damage sustained or caused by their child during participation.

PRIVACY & AMENDMENTS

16. The Provider will collect and store personal information in accordance with applicable privacy laws and regulations.

17. Any amendments or modifications to this agreement must be made in writing and signed by both parties.

18. This contract shall be governed by the laws of [State/Country].

19. This agreement constitutes the entire agreement between the parties and supersedes any prior discussions, agreements, or understandings.
